Under what circumstances can one participate in community service?

According to the amendment to Article 41 of the Criminal Code mentioned above, cases involving a sentence of up to 6 months of imprisonment or detention, as well as cases involving the option of converting fines into labor, are eligible for applying for community service. Additionally, in cases where multiple offenses are subject to fines or community service, if the total sentence to be served exceeds six months, the option of community service can also be applied. However, individuals who are elderly, weak, disabled, or suffering from serious illnesses that make them unsuitable for providing community service, or those for whom community service is unlikely to achieve corrective effects or maintain public order, may be exempted from participating in community service at the discretion of the prosecutor. It should be noted that individuals who are unwilling to perform community service will not be compelled to provide labor services.
