How to Apply for Suspension (Postponement) of Execution:
1. Period for Application: The application can be made at any time between the finalization of the judgment and the completion of the execution.
2. Applicants: The convicted person, legal guardian, spouse, or interested party.
3. Application Procedure: Submit an application form to the relevant authority along with supporting documents.
4. Grounds for Application: The following circumstances may qualify for the suspension (postponement) of execution:
• Mental incapacitation: Lack of perception, comprehension, and judgment to make independent decisions. A diagnosis certificate from a public hospital must be provided.
• Pregnancy of five months or more: Supporting documentation is required.
• Recent childbirth (less than two months): A birth certificate must be provided.
• Current illness that poses a threat to life if execution proceeds: A diagnosis certificate from a public hospital must be provided.
• Call-up for military service (with a sentence not exceeding six months and the period of service not exceeding six months until discharge or release from service): A call-up order must be provided.
Review Criteria and Processing Result: The prosecutor will review the documents and if they meet the requirements mentioned above, the execution will be suspended (postponed) until recovery or the resolution of the circumstances. The applicant will be notified of the decision.
