How to Apply for Commutation to a Fine

1. For minor crimes where a short-term imprisonment sentence is imposed, according to the provisions of the Penal Code, the following conditions must be met in order to apply for commutation to a fine:
• The maximum penalty for the committed offense (i.e., the highest punishment prescribed by law for a certain crime) is a term of imprisonment not exceeding five years.
• The court-imposed sentence is a term of imprisonment not exceeding six months or a detention.
2. In cases eligible for commutation to a fine, if the convicted person has left the country and has not returned, is working on a deep-sea fishing vessel, or is seriously ill and unable to personally appear for proceedings as certified by a medical professional, the convicted person's spouse, blood relatives within the third degree, or in-laws within the second degree may apply on their behalf with reliable supporting documents.
3. For the application of commutation to a fine, it can be made orally or in writing to the authority. The application will be granted unless the executing prosecutor determines that executing the imposed sentence would be difficult to achieve correctional purposes or to maintain public order. Any attempts to influence or engage in improper lobbying will be strictly investigated.
