How to claim a guarantee payment in a criminal case:
1. Applying for guarantee payment:
• The defendant, upon being granted bail, will receive a payment notification from the police office.
• A family member or friend should present the payment notification at Counter X of the "Service Center for Citizens" to obtain a payment receipt.
• The payment should then be made at Counter X, and the receipt should be kept for further release procedures.
2. Procedure for guarantee payment:
• The defendant can handle the procedure personally or assign a family member or friend to handle it on their behalf.
• Inform the family member or friend to visit the police office and carry out the necessary procedures via telephone, written communication, or other means.
3. Types of guarantees:
• Personal guarantee: A reliable person within the jurisdiction of the police office (with a legitimate occupation) provides a guarantee letter. The person must fill out the guarantee form, sign or affix a seal, submit identification documents, and present proof of assets.
• Cash guarantee: The defendant or guarantor pays the designated amount of cash or negotiable securities (based on current market value) without the need for a guarantee letter.
4. Payment of guarantee:
• Designated personnel at the police office will receive the payment after working hours and submit it to the national treasury on the following day.
5. Methods of fulfilling the responsibility:
• The person responsible for guarantee payment must be either a legal representative or an appointed agent of the defendant. Alternatively, they can be a respected family member or a reliable person with a legitimate occupation residing within the jurisdiction of the police office.
• The responsible person should present their national identification card, fill out the responsibility form, affix a seal, sign, or provide a fingerprint.
• Once the guarantor completes the necessary guarantee procedures or the person responsible fulfills their obligations, the defendant will be released immediately.
• If the defendant cannot complete the guarantee procedure on the same day as approved by the prosecuting attorney, an application for guarantee should be made to the court.
• No fees are charged for processing guarantees, responsibilities, checking guarantees, or counter-guarantees by police officers.
6. Processing period: The procedure is handled promptly upon submission.
